Written appeals
Procedure for considering appeals of individuals and legal entities
The competence of the Department for Humanitarian Activities of the Property Management Directorate of the President of the Republic of Belarus (hereinafter – the Department) includes the consideration of appeals of citizens, including individual entrepreneurs and legal entities (hereinafter – appeals), on issues of:
- work with the property seized, arrested, confiscated or otherwise forfeited;
- receipt and use of foreign gratuitous aid;
- licensing of activities regarding children’s recuperation abroad.
Written appeals are submitted to the Department by personal delivery (courier), by mail, during individual appointment, by making comments and (or) suggestions to comments and suggestions book.
Written appeals of individuals should contain:
- name of the Department;
- name, patronymic (if any) or initials of an individual, surname, residence address (place of stay) and (or) place of work (study);
- formulation of the essence of the appeal;
- personal signature of the individual.
Written appeals of legal entities should contain:
- name of the Department;
- full name of the legal entity and its location;
- formulation of the essence of the appeal;
- name, patronymic (if any), surname of the head or a person duly authorized to sign appeals;
- personal signature of the head or a person duly authorized to sign appeals certified by the seal of the legal entity.
Oral appeals are set out during individual appointment. When making an oral appeal, a citizen should provide with his/her ID. Oral appeals are deemed decided on the merits if all issues set out therein are resolved and responses are announced to the applicants during individual appointment.
The received appeals are considered by the Department officials responsible for solving the issues set out in the appeals. For information about officials in charge for appeal please call at: 222 47 05.
Appeals containing issues that do not fall within the competence of the Department, within five days from the date of their receipt are directed to the relevant state bodies, other agencies (officials) for considering the merits, with notification of the applicant.
Appeals are considered not later than fifteen days from the date being registered with the Department, and appeals that require additional study and check – not later than one month.
In the event information from a foreign country and (or) an international organization is required to resolve the issues set out in the appeal, the one-month term of considering the appeal may be extended with simultaneous notification of the applicant
Written appeals may be left without considering the merits if:
- the written appeal does not meet the requirements set out in clauses 1-6, Article 12 of the Law of the Republic of Belarus on appeals of individuals and legal entities;
- appeals are subject to resolve according to the law on constitutional legal proceedings, civil, civil proceedings, economic proceedings, criminal proceedings legislation, legislation governing the order of administrative procedure, law on administrative proceedings;
- appeals contain issues beyond the Department’s competence;
- the applicant filed a second appeal, if it has already been considered on the merits and it does not contain new circumstances critical for the appeal to be decided on the merits;
- correspondence with the applicant on issues set out in the appeal has been terminated.
Oral appeals may be left without considering the merits if:
- documents stating the identity of the applicant, its proxy, as well as documents confirming the powers of the applicant’s proxy, are not provided;
- appeals contain issues beyond the Department’s competence;
- the applicant has already been given an exhaustive response to his/her questions during individual appointment, or the correspondence with this applicant on such issues has been terminated;
- the applicant allows the use of obscene or offensive words or expressions during individual appointment.
The resolution of the Department on the appeal may be complained against in the Property Management Directorate of the President of the Republic of Belarus.
